Rules for participation in sweepstakes on hitchecker.de
§1 General information about sweepstakes
In competitions, hitchecker.de usually works with cooperation partners who act as prize sponsors. hitchecker.de represents you in the implementation of the sweepstakes and is not obliged to do any work of your own. In some competitions, hitchecker.de also acts as a prize sponsor.
§2 Participation in the competition
2.1 In order to take part in a competition, it is necessary to fill out the associated competition form in full and then send it off. Each participant is responsible for the correctness of their information. Participation must be completed by the specified deadline. The electronically logged date of receipt of a submitted sweepstakes form is used to check whether this deadline has been met.
2.2 Data protection is a top priority at hitchecker.de. Therefore, as little personal data as possible is requested via the competition form. As a rule, it is sufficient to provide a valid e-mail address. Further information such as first and last name, address or telephone number only has to be provided in exceptional cases if this is necessary for the timely processing of the competition.
2.3 Submitting the competition form and the resulting participation in the competition are only possible if all mandatory fields have been filled out completely and correctly. In most competitions, participants have to answer a competition question correctly or enter a competition code. The necessary competition code is provided by hitchecker.de.
2.4 Participation in a Sweepstakes requires acceptance of these Rules of Entry. Participation via comment forms on hitchecker.de or comments on contributions on hitchecker.de's social media profiles (Twitter, Facebook, Instagram, Pinterest, Flipboard, etc.) is generally not possible.
2.5 Participation and the chances of winning do not depend in any way on the purchase of goods or the use of paid or unpaid services from hitchecker.de or other companies involved in organizing the competition.
2.6 The cash payment of the raffled prizes is excluded.
2.7 Only persons over the age of 18 residing in Germany are entitled to participate in the competitions on hitchecker.de. Legal representatives and employees of hitchecker.de as well as possible cooperation partners of the competition are generally excluded from the competition.
§3 Exclusion from participation
3.1 hitchecker.de is entitled to exclude participants from competitions without notice if they violate the rules of participation and in particular in the case of attempts at manipulation. This includes multiple participation under different e-mail addresses. Registration via a provider whose business purpose is, among other things, the manipulation of sweepstakes leads to exclusion.
3.2 Sweepstakes entry services are fundamentally excluded from participation. In the event of an infringement, hitchecker.de expressly reserves the right to take legal action against such services.
3.3 In order to participate in the competition, all personal information must be correct. Otherwise, the participant can also be excluded from the competition.
§4 Cancellation and change of the competition
4.1 hitchecker.de is entitled to cancel the raffle in whole or in part. This applies in particular if the raffle cannot take place as planned, for example if computer viruses occur, software and/or hardware errors occur and/or for other technical and/or legal reasons. This also applies to manipulations or attempts at manipulation that affect the administration, security, integrity and/or regular and proper execution of the raffle.
4.2 hitchecker.de also reserves the right to change or correct the regulations of competitions at any time. Sweepstakes can be extended at any time without giving reasons.
§5 Data processing
5.1 hitchecker.de collects the data requested from the competition participants and stores it on a server for the duration of the competition. Further information on data storage can be found in our data protection declaration. The data will only be used to process the competition. In the event of a win, a participant will usually first be contacted by hitchecker.de by e-mail, if necessary also by telephone or by post, in order to clarify the details. By accepting these Rules of Participation, contestants agree to this.
5.2 hitchecker.de is entitled to transmit the winner's data to cooperation partners / prize sponsors in order to enable delivery of the prize. For the purpose of processing the competition, the participants agree that they may also be contacted by the cooperation partners by e-mail, telephone or post for this purpose.
§6 Handling and prices
6.1 The prizes will be raffled among all participants who answered the competition question(s) correctly or entered the correct competition code. If no participant has answered correctly, the raffle will take place among all participants in a competition.
6.2 The winners will be notified after the closing date for a competition and can be announced on hitchecker.de and/or the website of the respective cooperation partner. hitchecker.de only publishes the first name including the first letter of the last name and the place of residence of the winner. In the case of digital prizes in particular, such as software licenses, hitchecker.de leaves it up to the winners whether they want to reveal themselves as the winners and leave a short greeting in the comment field for the relevant competition entry. By confirming these rules of participation, a winner expressly agrees to the form of notification and publication described. The consent to the publication of the specified data can be revoked at any time by the competition participants (>> Imprint) and is independent of participation in the competition.
6.3 The prizes presented in sweepstakes are not necessarily identical to the items won. There may be deviations (model, color...). Prize sponsors may select an item of average type and quality of equivalent value to the item presented as the prize.
6.4 The prizes will be sent by hitchecker.de, a prize sponsor or a commissioned third party to the postal address provided by the winner by freight forwarder, parcel service or post. On the first delivery attempt, delivery is free within Germany, unless otherwise stated in the competition or expressly agreed. The winner must bear any additional transport costs and customs duties. The place of performance remains the place of business of the price sponsor despite the assumption of the shipping costs.
6.5 In the case of travel prizes, the processing takes place in direct contact between the winner and the respective prize sponsor or a tour operator commissioned by them. If a travel date is not specified in the prize draw itself, the prize sponsor or tour operator alone is entitled to set the date for the trip. There is no entitlement to a specific travel date. If the trip is not carried out on the date or time specified by the prize sponsor or tour operator, there is no longer any entitlement to the prize. With the confirmation of the trip, the winner is subject to the travel conditions of the organizer. Travel to and from the starting point of the trip (airport, train station, etc.) is at the winner's expense, unless otherwise stated in the competition or expressly agreed. The same applies to all costs incurred during the trip (minibar, telephone, etc.). The value of the trip in the advertisement text refers to the most expensive travel time and is therefore subject to seasonal deviations and currency fluctuations, depending on the time at which the trip is made available and taken. Compensation for this difference in value is excluded.
6.6 Entitlement to the Prize or Prize Substitute is non-assignable.
§7 Data deletion and revocation
7.1 hitchecker.de deletes the data completely as soon as the competition has been carried out and ended by drawing and sending the prizes or has been canceled according to §4.
7.2 The participants can revoke their consent to the processing of the data and their participation in the competition at any time. Furthermore, you have the right to information and correction with regard to the data collected. §8 Liability
8.1 hitchecker.de is released from all obligations upon delivery of the prize, unless an earlier point in time results from these regulations.
8.2 hitchecker.de is not liable for material and/or legal defects in the prizes donated by the cooperation partner.
8.3 hitchecker.de is also not liable for the insolvency of a cooperation partner and the resulting consequences for the implementation and processing of the competition.
8.4 In the case of travel prizes, hitchecker.de is not liable for the consequences of a justified change to the travel offer or the justified cancellation of the trip by the tour operator. The possibility of payment of the travel value is excluded.
8.5 Any liability for the existence of the technical requirements for participation in the competition or the sending of the prizes by transport companies is excluded.
§9 Miscellaneous
9.1 Legal recourse is excluded.
9.2 The law of the Federal Republic of Germany applies exclusively to all legal relationships arising from or in connection with these conditions of participation and data protection regulations.
